Terms of Service

The deal in plain language: Netly measures your connection, keeps the results on your phone, and asks nothing of you in return — no account, no ads, no payment. Here is what that does and does not promise.

The short version. Use Netly to test your own connection as much as you like. Do not attack other people's networks with it. The numbers are a best-effort measurement, not a certified reading — do not use them alone to win an argument with your ISP, and do not expect us to be liable for decisions you make from them.

1. Accepting these terms

By installing or using Netly (“the app”) you agree to these Terms of Service. If you do not agree, do not use the app — uninstalling it removes everything it stored, because everything it stored was on your phone.

2. What Netly is

Netly is a network measurement tool. It runs a speed test (ping, jitter, packet loss, download, upload) and a video test (time to first frame, buffering, smooth playback percentage) against test servers, then keeps a history of those results on your device so you can compare networks over time.

The app is free. There is no account, no subscription, and no advertising. We do not sell anything inside it.

3. Your licence to use it

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own purposes (personal or business alike).

You may not copy, sell, rent, sublicense or redistribute the app; reverse engineer, decompile or disassemble it except where that right cannot be excluded by law; or remove any notice of ownership from it.

4. How you may not use it

We may block access to our test servers from any source that does these things.

5. About the measurements

A speed test measures what one device achieved, over one route, to one test server, at one moment. Wi-Fi conditions, the device itself, the test server's own capacity, and traffic elsewhere on your line all move the number. Repeat readings of the same line will differ.

Netly's results are a best-effort indication, not a certified measurement. They are not produced under a regulatory testing regime and we do not present them as evidence of what any provider contracted to deliver. If you need a reading that carries weight with an ISP or a regulator, use the measurement programme your regulator recognises.

A test consumes data from your plan — roughly 12 MB for a speed test and 15 MB for a video test. On a metered connection that costs you money; deciding when to run a test is your call, and the app tells you the expected size before you start.

6. Your data

Results, labels and settings stay on your device. We do not receive them. During a test, the test server necessarily sees your IP address the way any server you connect to does. The full detail is in the Privacy Policy, which forms part of these terms.

Because your history lives only on your phone, deleting the app deletes it. Keeping a copy is up to you — Android's own backup may include it if you have that switched on.

7. Third-party material

The video test streams a short sample clip derived from Big Buck Bunny © Blender Foundation, used under the Creative Commons Attribution 3.0 licence. The attribution is shown inside the app.

The app uses third-party components and services (including Google Play services and Firebase Remote Config for configuration, and content delivery providers for test endpoints). Their own terms govern those services.

Android and Google Play are trademarks of Google LLC. We are not affiliated with, endorsed by, or sponsored by any internet service provider named in your test results; network and carrier names appear only because your device reports them.

8. No warranty

The app is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy of measurements, and uninterrupted availability of test servers.

We do not promise that a test will always succeed: servers go offline, networks drop, and the app will tell you when a measurement could not be completed rather than invent a number.

9. Limits of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, for lost profits or data, or for decisions you take based on a measurement — including switching provider, changing a plan, or disputing a bill.

Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If mandatory consumer law in your country gives you rights beyond these terms, those rights stand.

10. Changes and ending

We may update these terms as the app changes. The version and effective date at the top of this page tell you which text applies; continuing to use the app after an update means you accept the new version. Material changes will be noted in the app's release notes.

You may stop at any time by uninstalling the app. We may suspend or end your licence if you breach section 4.

11. Governing law

These terms are governed by the laws of the Socialist Republic of Viet Nam, without regard to conflict-of-law rules, and the courts of Ha Noi have jurisdiction — except where the mandatory law of your country of residence gives you the right to bring proceedings locally.
